Virginia Marijuana Possession Laws
As 2019, marijuana is still illegal in Virginia, however, the medical use of marijuana has been legalized. This allows prescriptions to be made for limited amounts of CBD oils to be used for medical purposes. CBD oils are different than other forms of marijuana as it does not have the psychoactive component THC.
If you are caught with any form of marijuana (including CBD without a prescription) you may be charged with possession of an illegal substance. Possession of marijuana may come with up to $500 in fines &/or up to 30 days in jail for your first conviction and up to $2,500 in fines &/or up to 1 year in jail. It is important to note the amount of marijuana that is found in your possession directly impacts the severity of your specific case; especially if there are other enhancements such as being near a school or driving.
Don't Be Discouraged by a Confidential Informant
Virginia police and federal officers often use confidential informants to go after people they suspect of using or dealing drugs. If you were arrested because of your interactions with a confidential informant, your case is not over.
The informants are often people who are trying to minimize their own punishment by telling state or federal officers about people they know who are using drugs. Sometimes the information they provide is an exaggeration and sometimes it is utter fabrication.
Our firm has worked on high-profile cases involving confidential informants. We are aware that you may have been solicited by a persistent informant who was trying to get you into trouble. When you work with Alex Levay Attorneys, PLLC, we can attack the informant's credibility and challenge both the chain of custody and the forensic analysis of evidence. This can mean the difference between freedom and time in prison.
